RULES for COMPILATIONS
These rules and regulations pertain to all compilations offered by BARE METAL
Records and all bands / performers on said compilations.
Get the FORM. See below on the left side.
OFFICIAL RULES & REGULATIONS:
1. SUBMISSIONS:
If selected, your music will appear on the compilation CD that will be available to top
music industry creative executives in A&R, music publishing, film & TV music as well as
artist managers, record producers, radio programmers and more. The CD will also be
promoted and sold online and possibly in retail outlets. It will be sent to US troops
serving in Iraq.
Also, you will receive 10 free copies of the CD that are yours to distribute as you see
fit. Additional copies can be purchased. This will allow all of the artists/bands on the
compilation to have a chance to be heard in states that may otherwise not have been
accessible. If you wish to distribute the CD to your own contacts, local college radio
stations, commercial radio stations, etc., then by all means do so; this gives all the
artists on the CD even more exposure. Keep in mind that the other artists/bands may
be doing the same thing. An additional fee of $80.00 must be paid after your band is
chosen.
2. Who Is Eligible:
a) Any recording artist/band that is not currently under contract with a record company.
Any NATIONAL recording artist who is signed to a major record label with the proper
legal paperwork & permissions.
b) Artists/bands signed to publishing deals but who do not have recording contracts will
also be accepted.
c) All music submitted must be 100% owned and copyrighted to entrant and master
rights to the sound recording must be 100% controlled by the entrant. All submissions
must be entrant's original work. Any song containing any "Samples" will be
automatically disqualified. NO cover songs! No song previously recorded and released
through national distribution in any country will be eligible.
d) All entrants must be eighteen (18) years of age or older at the time of submitting
material, or provide writtien permission from their legal guardians/parents.
e) Artists/bands signed to small independent record companies will be accepted if
written permission fom the label is provided in advance.
f) Open to any band of any genre!
3. Process to Enter and Submission Fees:
You may enter by postal mail.
To enter by mail:
a) Send a completed and signed submission form.
b) Send 1 Audio CD. Must be master quality. No cassette submissions will be
accepted.
c) Submission Fee (US Dollars Only): $5.00 per song, maximum of 4 songs
per artist/band. Do not submit more than 3 songs. All submission fees are
non-refundable, no exceptions. Fee is for submission and does not guarantee
inclusion or a chance for any compilation. If song is on a mutli-track CD, you must
clearly indicate which song is being submitted, clearly. If chosen for the compilation
CD, you will be required to pay an additional fee of $80.00. This fee is to help offset
the production and distribution costs involved in this project and is non-refundable.d)

4. Submission Rules:
Mail your submission form, fees, and one (1) master quality audio CD to BARE METAL
Records. No cassette submissions will be accepted.
ALL BANDS SELECTED for the Compliation MUST SUBMIT THEIR CD, FEES, &
ENTRY FORM by MAIL.
No exceptions! Pay by credit card, Paypal, or money order. Then, send in the CD if
selected. An artist/band may submit up to 4 songs. All songs submitted must be
original compositions and at least two (2.0) minutes and not more than six and a half
(6.5) minutes in length. Writers retain all rights to their songs and lyrics. Submissions
must not contain samples or other copyright infringing elements that require clearance.
Excessive profanity may be edited in order to obtain a slot on the compilation. Only
one (1) artist/band per submission. BARE METAL Records
will review the songs that you have clearly marked for review on the submission form. If
you wish to submit additional artists/bands, a separate submission form and separate
fee are required. Agents and Managers may combine multiple submissions in one
package and pay with a single payment as long as each artist/band completes a
separate submission form. Submissions do not guarantee inclusion on the compilation
CD. Due to the volume of submissions we receive, BARE METAL Records will not be
able to provide "reviews" of all individual submissions. CD's or other materials
submitted to BARE METAL Records for a compilation will not be returned.
5. Submission Deadlines:
The submission deadline is determined by case by case basis. See individual
compilations for details.
6. Music Review & Selection Process:
All music submitted to BARE METAL Records will be reviewed by a panel of recording
industry professionals, as well as BMR staff. Final music selections are based, in part,
on commercial potential, originality, overall quality of performance and production. All
decisions of BMR will be final and will NOT be subject to appeal or review.
7. Notification:
Final artist/bands selected will be notified personally by telephone or email. Song
writer(s) and performers must sign and return an Agreement FORM confirming that the
selected song is original, that he/she controls the rights to the song and that he/she
consents to its use by BMR. Signing this agreement gives BARE METAL Records
permission to duplicate your song for the purpose of including it on the "BARE METAL
Records compilation for which it was chosen. At that time, you will also be asked to
provide information regarding your performing rights organization affiliation (i.e. BMI,
ASCAP, SEASAC, etc) as well as your publishing information & pay the $80.00
inclusion fee per song selected. Failure to sign and return the agreement within 8 days
of notification will result in immediate disqualification and an alternate artist/band will be
selected. All artists/bands whose music is not selected for the compilation CD will be
notified via email shortly after the final decisions have been made.
8. Release:
By submitting an entry(ies), entrants agree to be bound by these rules and by the
decisions of BARE METAL Records, which are final in all matters relating to the project.
Entrants hereby release and hold BMR and its sponsors harmless from any and all
liabilities, actions, suits, claims and demands of any kind which may be connected in
any way with this project, or that otherwise arise in any way in connection with this
project and will indemnify BMR, and al of our sponsors and affiliates, for any and all
costs and expenses incurred in defending any rights or claims made regarding entrant,
music, songs, or other material. All submissions constitute permission to use
artist/band names, likeness, descriptions and music for future publicity and advertising
purposes without compensation as BMR sees fit to do. BMR makes no claims or
guarantees of publication, recording, or other use of your material by any industry
professionals. This contract is legal and binding.
9. Royalties:
All winners will provide BMR with a royalty-free license to use the selected song(s) on a
non-exclusive basis. Winners that are selected and appear on OPERATION: Music
Storm will not be paid mechanical royalties for the song(s) that is included on the CD. It
is the artist's responsibility to register the songs with a tracking agency such as ASCAP
or BMI to receive royalties for airplay.
10. Artists Rights:
YOU will retain all copyrights to your songs/music/lyrics. BMR retains all rights to
all compilations and reserves all rights concerning their distribution & release.
11. Samples:
Each band chosen will receive ten (10) copies of the compilation CD at no charge.
Additional CDs can be purchased from CDBaby.com. Payment of all federal, state and
local taxes is the sole responsibility of the winners.
12. Miscellaneous:
BARE METAL Records is not responsible for lost, damaged, misdirected, postage due,
stolen or misappropriated submissions.
* No compilation will be made if the minimum of 30 usuable song entries is
not met. No refunds of fees for any reason. All bands selected must send a studio
quality CD & Entry form by mail.
